Montana Association of Realtors testified that a state mandate constitutes state-imposed zoning that circumvents the due process protections afforded to property owners through a local government’s land use regulatory authority, including notice, hearing, protest, referendum, and election. What’s most interesting about these streamside setback proposals is that, according to MAR staff research, a large majority of counties subject to the proposal already have streamside regulations in mainly their subdivision or zoning regulations.
