February 21, 2009 by remaxofwhitefishOn Thursday, the House Local Government heard for over two hours proponent and opponent testimony on House Bill 455, the Big Sky Rivers Act (Rep. Michele Reinhart). HB 455 would mandate that counties that contain Montana’s “Big 10” rivers – the Bitterroot, Blackfoot, Clark Fork, Flathead, Gallatin, Jefferson, Madison, Missouri, Smith and Yellowstone – establish 250-foot setbacks barring construction of residential, commercial, and other buildings within the setback width. The bill only applies to counties and requires variance procedures for property owners that experience hardship.
Montana Association of Realtors testified that a state mandate constitutes state-imposed zoning that circumvents the due process protections afforded to property owners through a local government’s land use regulatory authority, including notice, hearing, protest, referendum, and election. What’s most interesting about these streamside setback proposals is that, according to MAR staff research, a large majority of counties subject to the proposal already have streamside regulations in mainly their subdivision or zoning regulations. Testimony is available upon request. Of the 17 counties affected by HB 455, 13 have streamside regulations.
